These terms apply to every purchase on caracaltvart.com. Please read them before you buy.

1. Who we are

Caracal TV Art is a small business in the Netherlands.

2. What you buy

One digital art file per product: a JPG image of 3840 x 2160 pixels (16:9, 4K).
The download button gives you the original JPG file at once. Save it on your phone or computer.
The file has no copy protection (DRM).
It is made for TVs with an art mode, and for other TVs and screens that can show a JPG image. To put the file on your TV, you may need your TV maker's app or a USB stick.
Nothing physical is shipped. No frame and no print are included.
Product photos show the art in example rooms. These are mockups. The watermark on the photos is not on your file.

3. Made with AI

Our art is made with the help of AI design tools. We choose each image and prepare it as a 4K file for TV screens.

4. Prices and VAT

The price is on the product page and in the checkout. You see the total before you pay.
Buyers in the EU pay in euros. The price includes VAT. The VAT rate depends on your country; the price stays the same.
Buyers outside the EU pay in US dollars. If a tax applies where you live and we must charge it, the checkout shows it before you pay.
Your bank may charge a fee for paying in a foreign currency. We do not control this fee.
There are no shipping costs.

5. Ordering and payment

You can buy as a guest. A customer account is optional.
You pay at checkout with one of the payment methods shown there. The payment provider's own terms also apply to your payment.
You tick a box to ask for your download right after payment and to accept that you lose your right of withdrawal once the download starts. The box is in the cart.
The contract is made when your payment is complete. We then send you an order confirmation email.

6. Delivery

Right after payment, your order page shows a download button for each artwork. The "Open your downloads" button in your order confirmation email opens this page again.
No email? Check your spam folder. Still nothing after one hour? Email us and we send the link again.
The download link keeps working, so you can download your file again later. If it ever fails, email us with your order number and we send the file again.

7. Your license

We keep all rights we have in the art. You buy a license to use the file. Other buyers can buy the same file.

The files are made for screens. The license covers display on your own screens only. Printing is not included.

You may:

show the file on your own TVs, screens and devices, in your home or other private space,
keep backup copies for yourself.

You may not:

sell, share, give away or upload the file, or the download link, to others,
print the file, or sell anything made with it,
use it in a business, for example in a shop, hotel, restaurant or office,
use it in ads, logos, products or as part of other art you share or sell.

If you break these rules, your license ends.

8. Cancelling and refunds

You can cancel within 14 days, as long as the download has not started. At checkout you agree that the download is available right after payment, and that you lose your right of withdrawal once the download starts.

A faulty file, a file that does not open, or a file that is not as described: you get a new file or your money back. You also keep your legal rights for digital content that does not match what we agreed.

9. Changes to the shop

We may remove an artwork from the shop at any time. A file you already bought stays yours to use under these terms.

10. Liability

We make sure the file matches its description. Check that your TV or screen can show a JPG image of 3840 x 2160 pixels (see section 2).
As far as the law allows, we are not liable for indirect damage, such as lost time or lost profit.
As far as the law allows, our liability per order is limited to the price you paid for that order.
Nothing in these terms limits your rights as a consumer under the law. Nothing limits our liability for damage caused on purpose or by gross negligence.

How we use your data is in our Privacy policy.

12. Complaints

Please email complaints to enes@caracalproject.com. Add your order number. We reply as soon as we can, and at the latest within 14 days.

If you live in another EU country, the European Consumer Centre in your country can also help you.

13. Law and courts

Dutch law applies to these terms and to every purchase.
If you are a consumer and live in another country, you keep the protection of the mandatory consumer rules of your own country.
If we cannot solve a problem together, the competent court in the Netherlands decides. If you are a consumer in the EU, you can also go to the court where you live.
